The measure also affected the former manager of the Public Companies of Garzón ESP and the members of the Board of Directors of that entity.
The Attorney General’s Office issued a statement of charges against the former mayor of Garzón, Huila, Edgar Bonilla Ramírez (2016-2019), and five other former administration officials, for alleged irregularities in the authorization process to contract the cleaning service with a private company, as well as as in the award of this.
The others affected by the statement of charges are the former manager of the Public Companies of Garzón -Empugar ESP-, Francisco Enrique Calderón Feriz (2016 – 2018); and the former Secretaries of the Treasury, Diana Patricia Sierra Sánchez (2016 – 2019); of Transit and Transportation, Carlos Arturo Cano Medina (2016 – 2018); Legal, Mario Alejandro Vanegas Sosa (2017 – 2018), and Education, José Orminso Riaño Dussán (2016 – 2018).
According to the investigation, apparently Bonilla Ramírez and the former office secretaries, as members of Empugar’s Board of Directors, did not request authorization from the municipal council to grant powers to the manager of the entity and thus be able to contract with an individual, in this In the case of the company Interaseo SASESP, the operation of the cleaning service.
For the Public Ministry, with “the authorization to the manager of Empugar to confer the exercise of public functions to an individual, the structure of the municipal administration was being modified and changing the functions of the company, since it would then begin to exercise functions different from all those contained in its act of creation, such as ceasing to provide cleaning services”, reason for which it was necessary to resort to the authorization of the municipal council.
For his part, former manager Calderón Feriz would have directly contracted, thanks to the powers conferred, the provision of the cleaning service and all its administrative, operational and commercial components with Interaseo SASESP for a term of 15 years, extendable, when what corresponded it was a public tender that allowed the participation of more bidders and adjusted to the postulates of public contracting.
Due to these facts, the Garzón Provincial Attorney for Instruction described the alleged conduct of former mayor Bonilla Ramírez and the former office secretaries investigated as a serious offense committed by way of very serious negligence. In the case of Calderón Feriz, his apparent fault was classified as very serious as fraud.
The control body specifies that the apparent conduct investigated has not prescribed, in accordance with the provisions of the General Disciplinary Code (Law 2094 of 2021).
